Parole Approved

A client was successfully paroled into the U.S. last week for a period of 10 days for business purposes.  This client is inadmissible due a conviction for a crime involving moral turpitude that occurred 11 years ago. 

This individual had been traveling to the U.S. without issue since his conviction until earlier this year when U.S. Customs and Border Protection (“CBP”) officials denied his application for admission, notified him of his inadmissibility and told him to apply for a nonimmigrant waiver [Form I-192] (due to an increase in information-sharing technology between the U.S. and other countries, many foreign nationals with foreign convictions are having the same experience; foreign convictions that previously went undetected by the INS and CBP are now being discovered and serving as a basis for a finding of inadmissibility to the U.S.).   

This client immediately began the process of applying for a Form I-192 waiver, however, he had already scheduled a business trip for a large group to a U.S. destination prior to learning of his inadmissibility.  This trip cost nearly $300,000.00 with all funds payable to U.S. vendors.  The parole request focused on the importance of this trip to both the U.S. businesses as well as the client’s employment abroad.  In support of the parole request, a draft of the I-192 waiver application was submitted to demonstrate that the client is aware of the waiver requirement and is only waiting on the RCMP to produce his criminal history report before formally filing the application with CBP.  On this basis, parole was granted to allow this client to attend the business trip in the U.S.
