Parole Approved for Medical Treatment

We recently had a parole request granted on behalf of a client so that he could attend a mental health treatment facility in the United States.  This client was inadmissible to the U.S. pursuant to INA § 212(a)(1) – health-related grounds of inadmissibility.  

In support of our parole request to CBP officials at the land border port of entry, we submitted letters from the individual’s treatment providers in his native country of Canada, which indicated that the type of treatment required was not available in that country.  We also provided documentation from the U.S. treatment facility indicating that our client had already been accepted into the U.S.-based treatment program, that all program costs had been paid, and indicating the length of the treatment program.  Based upon this information, CBP officials agreed to parole this individual into the U.S. for a period consistent with the length of the treatment program – approximately 30 days.  In this case, it was extremely important to CBP officials that the inadmissible individual be under the constant supervision of mental health professionals at the treatment facility, and that the medical providers agreed to take responsibility for him during his time in the U.S.
